ANSI Approves Two New Construction and Demolition Standards

The American National Standards Institute (ANSI) has approved two new ASSE A10 construction and demolition standards:

A10.1-2011 - Pre-Project and Pre-Task Safety and Health Planning for Construction and Demolition Operations

A10.26-2011 - Emergency Procedures for Construction and Demolition Sites

The new 10.1-2011 standard establishes elements and activities for pre-project and pre-task safety and health planning for construction. Its primary purpose is to help make safety and health pre-planning a standard part of the planning processes.

The new A10.26 standard applies to emergency procedures involving: fires, collapses, hazardous spills and other emergencies; emergency rescue of injured or ill workers; on-site first aid and emergency medical care; evacuation and transportation of injured or ill workers and more. It also provides development guidelines for construction site emergency procedures.

New Truck Driver Hours-of-Service Rules Take Effect Feb. 27

A new DOT final rule reduces by 12 hours the maximum number of hours some truck drivers can work within a week. The rule mainly affects drivers who work more than 70 hours a week on a continuing basis - mostly long-haul truckload drivers. Local drivers and less-than-truckload drivers, who rarely work more than 5 days a week, are unlikely to be affected.

Under the old rule, truck drivers could work on average up to 82 hours within a seven-day period. The new HOS final rule limits a driver's work week to 70 hours. In addition, truck drivers cannot drive after working eight hours without first taking a break of at least 30 minutes. Drivers can take the 30-minute break whenever they need rest during the eight-hour window. The final rule retains the current 11-hour daily driving limit. The new on-duty time provisions are effective February 27. Rest break and restart rules take effect July 1, 2013.

Companies and drivers that commit egregious violations of the rule could face the maximum penalties for each offense. Trucking companies that allow drivers to exceed the 11-hour driving limit by 3 or more hours could be fined $11,000 per offense, and the drivers themselves could face civil penalties of up to $2,750 for each offense.

"Trucking is a difficult job, and a big rig can be deadly when a driver is tired and overworked," said Transportation Secretary Ray LaHood. "This final rule will help prevent fatigue-related truck crashes and save lives. Truck drivers deserve a work environment that allows them to perform their jobs safely."

EPA Lead Renovation, Repair and Painting Update

On July 15, 2011, The EPA issued a final rule (now in effect) amending provisions of the Lead Renovation, Repair and Painting rule:

Certified renovators can collect a paint chip sample and send it to a recognized laboratory for analysis.

Vertical containment or equivalent extra precautions are required on exterior renovations occurring within 10 feet of the property line.

Additional clarifications were made to the prohibited or restricted work practice provisions and the requirements for high-efficiency particulate air (HEPA) vacuums.

Minor changes were also made to the training program accreditation application process; Standards for e-learning in accredited training programs; Minimum enforcement provisions for authorized state and tribal renovation programs; and Training and certification requirements for renovators.

Since April 2010, federal law has required renovation, repair and painting contractors to earn lead certification and use lead-safe work practices. Lead-safe practices include posting warning signs and establishing barriers around the work area. According to the Environmental Protection Agency: Signs should be in the primary language of the occupants and should say 'Do Not Enter - Authorized Personnel Only' and 'No Eating, Drinking, or Smoking'.

Understanding ANSI / ASME Pipe Marking Standards

ComplianceSigns.com offers an extensive selection of pipe marking labels, stencils, wraps, tapes and valve markers. This article offers an overview of ANSI/ASME pipe marking standards for hazardous materials. For complete specifications, consult the ASME A13.1-2007 Standard.

The ASME A13.1 standard provides a system to identify hazardous materials transported in above-ground piping systems, as well potential hazards if the contents were released into the environment. It's commonly used in industrial and power plants, but is also recommended for use in commercial and institutional buildings and those used for public assembly. Pipe labels can be invaluable in an emergency situation, and will also help you comply with A13.1 standards.

Label Placement
Labels should be positioned on pipes so they can be easily read. Labels are required at the following locations:

Near valves and flanges

Where direction changes

On both sides of walls or floors the pipe passes through

At regular intervals on straight runs, spaced for easy identification

Label ContentPipe marking labels must effectively communicate the contents of pipes and give additional detail of any special hazards, such as pressures or extreme temperatures. Pipe labels should indicate both the content of the pipe and its direction of flow. Arrows at one or both ends indicate flow; content is indicated by text and by a standard color scheme. If contents can flow both directions, arrows in both directions shall be displayed.

Label Color
The current version of the ANSI / ASME code uses a color scheme with six standard color combinations and four user-defined combinations, based on the contents of the pipe. In general, the most hazardous feature of the contents should determine the color used. ANSI Z535.1 specifies exact safety colors for pipe labels.

Previous editions of the pipe-labeling code used a four-color scheme. The 2007 code applies only to new facilities; new labels in existing facilities should conform to the label scheme already in use to avoid confusion.

OSHA Extends Targeted Inspection Program for Federal Agencies

OSHA recently updated its Federal Agency Targeting Inspection Program (FEDTARG) directive that focuses on federal agency service/operating locations reporting high numbers of lost time cases. The directive outlines procedures for programmed inspections at some of the most hazardous federal workplaces. OSHA will inspect all establishments reporting 100 or more lost time cases (LTCs) during 2011; 50 percent of those establishments reporting 50 to 99 LTCs; and 10 percent of those reporting 20 to 49 LTCs.

Changes to this directive include provisions for reviewing alternate and supplementary standards for federal agencies (the equivalent of private sector variances from OSHA standards). Other changes include clarifications of how to determine the appropriate number and location of on-site inspections for establishments with multiple services or operations.

NTSB Says New DOT Hands-free Rule Doesn't Go Far Enough
A new DOT rule specifically prohibits commercial drivers from using hand-held mobile telephones while operating commercial trucks or buses. But the National Traffic Safety Board says that's not enough, and has called for a complete ban on cell phone use by all drivers, except in emergencies. NTSB says research shows there is no safety benefit to the use of hands-free cell phone devices. New Report Connects Health Care Worker Fatigue and Patient Safety
The link between health care worker fatigue and adverse events is well documented, with a substantial number of studies indicating that extended work hours contribute to high levels of worker fatigue and reduced productivity. Safety Tip: Protecting Workers from Carbon Monoxide

Carbon Monoxide (CO) poisoning causes hundreds of deaths and thousands of hospital visits every year in North America, and the risks increase as windows and doors are closed during the winter months. Internal combustion engines are the most common source of CO in the workplace. There are also exposure risks in boiler rooms, warehouses and many other locations and occupations.

Here are some carbon monoxide safety tips for employers from the Canadian Centre for Occupational Health and Safety:

Install an effective ventilation system that will remove carbon monoxide from work areas.

Maintain water heaters, space heaters, cooking ranges and other potential CO-producing equipment in good working order.

Use equipment powered by electricity, batteries or compressed air as an alternative to gasoline power.

Install reliable CO detector alarms that give both visual and audible warnings.

Don't allow the use of gasoline-powered engines or tools in poorly ventilated areas.

Test air quality regularly in areas where CO may be present, including confined spaces.

Have employees wear a certified breathing apparatus or supplied-air respirator in areas with high CO concentrations.

Test air quality before anyone enters confined spaces where CO is suspected.

Educate workers about CO sources and symptoms, how to protect themselves, and how to respond in case of an emergency.

Employees can help prevent CO poisoning by reporting any potential hazards to the employer, and looking out for ventilation problems - especially in enclosed areas where gases of burning fuels may be released.

DOT Bans Hand-Held Cell Phone Use by Commercial Drivers Effective Jan. 3

A new DOT rule takes effect January 3, 2012 that specifically prohibits commercial drivers from using a hand-held mobile telephone while operating a commercial truck or bus. New sanctions are also in place for drivers and carriers that violate the rule.

Drivers who violate the restriction will face federal civil penalties of up to $2,750 for each offense and disqualification from operating a commercial motor vehicle for multiple offenses. Additionally, states will suspend a driver's commercial driver's license (CDL) after two or more serious traffic violations.

Motor carriers are prohibited from requiring or allowing their drivers to use hand-held cell phones while driving, and will face a maximum penalty of $11,000. Approximately four million commercial drivers would be affected by this final rule.

BLS Reports Nonfatal Occupational Injury, Illness data for 2010

The rate of nonfatal occupational injury and illness cases requiring days away from work was 118 cases per 10,000 full-time workers in 2010, statistically unchanged from 2009, according to the U.S. Bureau of Labor Statistics. The total number of cases decreased 4 percent to 1,191,100, and the median days away from work was 8 days, the same as the previous year.

Key Findings:

The incidence rate for food preparation and serving related workers increased 10 percent to 116 cases per 10,000 full-time workers.
The incidence rate for healthcare support workers increased 6 percent to 283 days-away-from-work cases per 10,000 full-time workers.
Incidence rates for construction and extraction workers declined 17 percent
Contact with objects and equipment remained the top injury-causing event, followed by overexertion injuries, which increased by 3 percent.

OSHA Announces Two New National Emphasis Programs

Chemical facilities and nursing home / residential care facilities will be the focus of additional OSHA inspection efforts under two new National Emphasis Programs (NEPs) recently announced.

The new chemical NEP aims to reduce releases of highly hazardous chemicals. It replaces a 2009 regional pilot program and establishes policies and procedures for inspecting workplaces covered by OSHA's process safety management (PSM) standard. The inspection process includes detailed questions designed to gather facts related to PSM requirements and verification that employers' written and implemented PSM programs are consistent. Under the NEP, OSHA will conduct focused inspections at facilities randomly selected from a list of worksites likely to have highly hazardous chemicals in quantities covered by the standard.

The health care NEP, still in the planning stages, is in response to new data from the Bureau of Labor Statistics (BLS) showing an increase in the rate of nonfatal occupational injuries among health care support workers.

In a November announcement, OSHA head David Michaels noted the new health care emphasis program will involve increased inspections with a special focus on back injuries from resident handling or lifting. The program will also target exposure to bloodborne pathogens and infectious diseases, workplace violence and slips, trips and falls.

According to BLS, the rate of nonfatal injuries requiring days away from work for health care support workers in 2010 increased 6 percent to 283 cases per 10,000 full-time workers-almost 2.5 times the rate for all private and public sector workers.

New Research on Fall Injury and Prevention

A new document from NIOSH presents expert advice on the best way to understand, prevent and control fall-related risk exposures.

"Research and Practice for Fall Injury Control in the Workplace: Proceedings of International Conference on Fall Prevention and Protection" includes commentary, research findings, recommendations and expert advice on the latest tools and methods to reduce the incidence of injury from falls. New Tire Service Charts for Single- and Multi-piece Rim Wheels

OSHA has revised its tire servicing materials to address current hazards and help workers safely perform maintenance on large vehicle tires. OSHA's revised "Multi-piece Rim Matching Chart" provides an updated list of current and obsolete components and the old "Demounting and Mounting Procedures for Truck/Bus Tires" chart is now expanded into two charts that deal individually with tubeless and tube-type tires. The revised materials can be downloaded here.

New Nail Gun Safety Website
A Duke University researcher and the Center for Construction Research and Training launched a new nail gun safety website on December 2. NailGunFacts.org features video interviews with workers and information on how nail guns work and how to prevent nail gun injuries. It also provides access to nail gun research articles. OSHA Releases Construction Hazard Videos
OSHA has released a dozen online educational videos about potential hazards in the construction industry. The 12 videos cover falls in construction, workers who are struck by vehicles and heavy equipment, sprains and strains, trenching and excavation hazards, and carbon monoxide poisoning. The 2- to 4-minute animated videos are based on real-life incidents and include detailed depictions of hazards and the safety measures that could have prevented the injuries and fatalities.They are brief, easy to understand and geared to the needs of employers and workers. OSHA's On-site Consultation Program offers no-cost, confidential advice to small and medium-sized businesses across the country, with priority given to high-hazard worksites. Under the program, consultants from state agencies or universities work with employers to identify workplace hazards, give advice on OSHA compliance and assist in establishing safety and health management systems. In FY 2010 the program conducted over 30,000 worksite visits, at employer request. On-site Consultation services are separate from enforcement and do not result in penalties or citations. Safety Tip: Confined Spaces

Many workplaces include spaces that are considered "confined" because they restrict activities of employees who must enter, work in or exit from them. These spaces, such as tanks, manholes, silos or pipelines, often present increased injury risks. Here are some confined space safety tips from OSHA:

Do not enter permit-required confined spaces without being trained and without having a permit to enter.
Review, understand and follow employer's procedures before entering permit-required confined spaces and know how and when to exit.
Before entry, identify any physical hazards.
Before and during entry, test and monitor for oxygen content, flammability, toxicity or explosive hazards as necessary.
Use employer's fall protection, rescue, air-monitoring, ventilation, lighting and communication equipment according to entry procedures.
Maintain contact at all times with a trained attendant either visually, via phone, or by two-way radio. This monitoring system enables the attendant and entry supervisor to order you to evacuate and to alert appropriately trained rescue personnel to rescue entrants when needed.

Bringing Behavior-based Safety to Construction

On many construction sites there's an enforcer who is widely disliked. His mission is to spot workers violating safety rules, and to call out and penalize them. His heart is in the right place, and his ultimate objectives are sound, but his law-and-order approach makes him ineffective. Winter Weather Can Increase Dust Explosion Risks

Dust explosions often occur from November to March when there are higher static electricity concentrations, according to a panel of safety experts who spoke about combustible dust hazards at the recent National Safety Council Congress & Expo.

Nearly 280 dust fires and explosions have occurred in U.S. industrial facilities over the past 25 years, resulting in 119 fatalities and more than 700 injuries. Since launching a combustible dust National Emphasis Program in 2007, OSHA has issued 9,466 dust-related violations, but has not yet established a timeframe for a combustible dust standard.

The panel identified combustible dust safety hazards frequently found in plants and factories:

Dust collections located inside a building without proper explosion protection systems

High dust accumulations due to poor housekeeping

Improper deployment of venting

Improper protection of bucket elevators

Unprotected long ducts and pipes

Improper protection of silos and bins

Absence of building protection

Unprotected conveyors

Combustible dusts include: metals, textiles, wood, coal, plastic, biosolids and organics such as paper, sugar or dried blood. Without proper housekeeping, even a facility below OSHA's PEL (permissible exposure limit) for process-generated dust can accumulate enough dust to become dangerous. If drafts, vibrations or other incidents send settled dust into the air near an ignition source, a fire and dust explosion could occur.

"Safety managers need to consider facility design, have dusts tested at a certified lab, and establish a detailed process hazard analysis, housekeeping protocols, and operator- and technical-level training," said panel member Kevin Jeffries, senior safety manager of frozen foods for Kellogg Company.

Lockout / Tagout Fines Nearly Double Since 2009

LOTO has been in the top 10 most-cited regulations for more than 15 years, but in the past two years, OSHA fines associated with LOTO have nearly doubled - to a record high approaching $6.2 million. And that accounts only for states under federal jurisdiction. When combined with individual state totals, LOTO fines reached more than $10 million in the 2010-11 reporting year.

While the total fine amount has rocketed upward, citation and inspection numbers have remained relatively steady at about 2,000 inspections and 4,000 citations. This seems to indicate heavier fines for LOTO citations, rather than poor compliance. With OSHA's new push for zero workplace incidents, it's a safe bet that regulations on the Top 10 list will continue to be prime targets for inspectors.

Signs with Braille: CAPS, Initial Caps or lowercase?

We frequently receive questions regarding the Braille dots on restroom signs, especially the lack of the "double dot" all caps designation before the name of the room (MEN, WOMEN, etc.). According to ANSI/ASME A17.1-2007, ANSI A117.1-2003, and the United States Access Board July 23, 2004 Accessibility Guidelines (Section 703.3.1), the following description of capitalization for Braille should be used:

Braille shall be in accordance with literary Braille, except the indication of an uppercase letter or letters shall only be used before the first word of sentences, proper nouns and names, individual letters of the alphabet, initials, or acronyms.

Because room names don't meet the criteria requiring capitalization, and capitalization doesn't alter the interpretation of the function of the room, Braille restroom and room name signs at ComplianceSigns.com do not include the double dot signifying capital letters.

GHS Delayed Until Late 2012, or After?

We've been watching for OSHA direction on the Globally Harmonized Standard (GHS) for several months. Now OSHA head David Michaels says OSHA's new hazard communication standard may be finalized in the early part of 2012, but that the Globally Harmonized System of Classification and Labeling of Chemicals (GHS) won't go into effect at that time.

Like most OSHA regulations, it would take effect some time later, perhaps up to six months after the new standard is finalized. GHS is expected to provide standardization of MSDS formats in the U.S. and other countries.

NFPA Offers Electric Vehicle Safety Training for Emergency Responders.
NFPA's Electric Vehicle Safety Training project is a nationwide program to help firefighters and other first responders prepare for the unique challenges posed by the growing number of electric vehicles on the road in the U.S. Topics include: identifying electric vehicles, power down procedures, recommended fire practices and general operation of the vehicles. ANSI Issues Revised Sign / Label Standards.
ANSI recently revised six standards relating to safety signs and colors used in public spaces, workplaces, and industrial and consumer products. Crane Inspector Certification Launched.
The National Commission for the Certification of Crane Operators (NCCCO) and the Crane Certification Association of America (CCAA) launched a new CCO national crane inspector certification program on November 1st. The new program allows workers with at least five years of crane-related experience to earn a professional credential that demonstrates their qualification to inspect cranes. NCCCO reviews each application and individually approves candidates before permitting them to apply to take the crane inspector exams. Read more here.

OSHA Publishes New Safety Materials for Laboratory Managers and Workers.
New OSHA materials can help laboratory managers protect their workers from exposure to chemical, biological, and physical hazards. The materials include a Laboratory Safety Guidance document that describes how electrical hazards, fire, explosions, falls and other hazards can be minimized or eliminated if employers use safety plans, worker training, engineering controls and personal protective equipment. OSHA Offers Crowd Management Guidelines for Retail Safety.
As hectic holiday shopping approaches, OSHA encourages major retail employers to take precautions to prevent worker injuries during Black Friday and other major sales events. The agency's Crowd Management fact sheet recommends elements including trained security personnel, barricades or rope lines for pedestrians and having security personnel or customer service representatives explain approach and entrance procedures to the arriving public. SAFETY TIP: Using a Fire Extinguisher

A portable fire extinguisher can save lives and property by putting out a small fire or containing it until the fire department arrives; but portable extinguishers have limitations. Here are some fire extinguisher safety tips from the NFPA:

Use a portable fire extinguisher when the fire is confined to a small area, such as a wastebasket, and is not growing; everyone has exited the building; the fire department has been called or is being called; and the room is not filled with smoke.

To operate a fire extinguisher, remember the word PASS:

Pull the pin. Hold the extinguisher with the nozzle pointing away from you, and release the locking mechanism.

Aim low. Point the extinguisher at the base of the fire.

Squeeze the lever slowly and evenly.

Sweep the nozzle from side-to-side.

Choose a fire extinguisher that carries the label of an independent testing laboratory.

Read the instructions that come with the fire extinguisher and become familiar with its parts and operation before a fire breaks out. Local fire departments or fire equipment distributors often offer hands-on fire extinguisher training.

Install fire extinguishers close to an exit. Keep your back to a clear exit when you use the device so you can make an easy escape if the fire cannot be controlled.

Know when to go. If the room fills with smoke, leave immediately. Fire extinguishers are one element of a fire response plan, but the primary element is safe escape

Every location should have a fire escape plan and working smoke alarms.

OSHA Issues Directive on Workplace Violence

The Occupational Safety and Health Administration recently issued a directive on enforcement procedures for investigating or inspecting incidents of workplace violence. The directive establishes procedures for OSHA field staff responding to incidents and complaints of workplace violence and conducting inspections in industries considered vulnerable to workplace violence.

The directive outlines the types of businesses and the reasons why inspectors will review a company's workplace violence prevention efforts. Inspections will be conducted if:

Workplace violence results in a worker fatality or three or more hospitalizations
An employee files a workplace violence complaint, or
The company is in an industry with known risk factors for workplace violence

OSHA-identified high-risk industries are:

Healthcare and social service settings
Late-night retail settings

OSHA doesn't have a standard on workplace violence, but the agency says it will issue citations under the General Duty Clause. The agency has launched a new web page on Preventing Workplace Violence and published several workplace violence guidance documents including Recommendations for Workplace Violence Prevention Programs in Late-Night Retail Establishments and Guidelines for Preventing Workplace Violence for Health Care and Social Service Workers.

Studies by NIOSH and other organizations show that employers who implement effective safety measures including employee training and conducting workplace analyses can reduce the incidence of workplace violence.

Are Your Respirators Really NIOSH-Approved? Here's How to Find Out

Buying a respirator can be confusing, especially because some facepieces are marketed and advertised as NIOSH-approved when, for a variety of reasons, they are not actually certified. NIOSH recently launched a new campaign, "Know It's NIOSH," to make it easier to identify true NIOSH-certified respirators. The project includes a respirator source web page to help you verify if your respirators are actually NIOSH-approved. It also provides other useful respirator information.

ASSE / ANSI Announce Prevention-Through-Design Standard

The American Society of Safety Engineers (ASSE) has approved a new standard providing guidance on including prevention-through-design concepts in occupational safety and health management systems for any workplace setting. The ANSI/ASSE Z590.3 standard, "Prevention through Design: Guidelines for Addressing Occupational Risks in Design and Redesign Processes" will soon be available online.

The standard focuses specifically on how to avoid, eliminate, reduce and control occupational safety and health hazards and risks during design and redesign processes. Concepts presented in the standard can be incorporated into the design/redesign of work areas, tools, equipment, machinery, substances and work processes. It can also apply to construction, manufacture, use, maintenance, disposal and reuse of equipment used on-the-job.

Seven Practices that Contrubuted to the BP Disaster - Are Any Yours?

The final report on the BP oil Deepwater Horizon disaster in the Gulf of Mexico identifies seven company practices that contributed to the incident. Technical reasons for the explosion include problems with cement barriers, production casing and lock-down sleeves.

But the report also cites seven company practices that contributed to the explosion. And they're mistakes that could be made by any company, not just an oil giant:

Failure to stop work after encountering multiple hazards and warnings

Failure to fully assess the risks associated with operational decisions

Making cost- or time-saving decisions without considering contingencies and mitigation

Failure to ensure all risks associated with operations were as low as reasonably practicable

Failure to have full supervision and accountability over activities

Failure to document, evaluate, approve and communicate changes associated with personnel and operations

Failure to ensure a common integrated approach to well control

The report from the Bureau of Ocean Energy Management, Regulation and Enforcement (BOEMRE) says the explosion that killed 11 workers and sent almost five million barrels of oil into the Gulf resulted from "poor risk management, last-minute changes to plans, failure to observe and respond to critical indicators, inadequate well control response, and insufficient emergency bridge response training by the companies responsible."

OSHA and NIOSH have developed a new guidance document titled "Nail Gun Safety - A Guide for Construction Contractors" to help construction employers and workers prevent work-related nail gun injuries. The guide highlights information on nail gun injuries, describes common injury causes and provides six practical steps contractors can take to prevent these injuries. It includes actual workplace cases along with a short section on other types of nail gun hazards and sources of additional information. Download the guide here (pdf).

OSHA Extends Comments on Occupational Injury / Illness Tracking, Reporting to Oct. 28.
OSHA has re-opened the comment period on revising recordkeeping and reporting requirements for work-related injuries and illnesses. Individuals interested in submitting comments must do so by Oct. 28, 2011. Under the revised proposal, employers would be required to report to OSHA any work-related fatalities and all in-patient hospitalizations within eight hours, and work-related amputations within 24 hours. OSHA also proposes to update rule Appendix A that lists industries partially exempt from the requirements. Read more from OSHA here.

Observe Drug-Free Work Week October 17-22

The department of Labor has declared October 17-22 as Drug-Free Work Week, a time to highlight the benefits that a drug-free workplace brings to employers, workers and communities. And according to recent research, it's a message that many workers (and employers) need to hear.

75 percent of illegal drug users in the U.S. are employed - and 3.1 percent say they have used illegal drugs before or during work hours.
79 percent of the nation's heavy alcohol users are employed - and 7.1 percent say they have consumed alcohol during the workday.

Drug-free workplace programs can help protect employers and employees from the potentially devastating consequences of worker alcohol or drug abuse. Establishing drug-free policies, educating workers about the dangers of alcohol and drug use, deterring and detecting their use and urging people to seek help for alcohol and drug problems are smart safety strategies. They're also smart business strategies.

Safety Tip: Aerial Lifts

Aerial lifts include boom-supported aerial platforms, such as cherry pickers or bucket trucks. (OSHA regulates scissor lifts as mobile scaffolds, not as aerial devices.) The major causes of aerial lift fatalities are falls, electrocutions and collapses or tip-overs. Here are some OSHA tips for safe work practices:

Never move the equipment with workers on an elevated platform unless this is permitted by the manufacturer.
Do not allow workers to position themselves between overhead hazards, such as joists and beams, and the rails of the basket. Movement of the lift could crush the worker(s).
Maintain a minimum clearance of at least 10 feet, or 3 meters, from the nearest overhead lines.
Always treat power lines, wires and other conductors as energized, even if they are down or appear to be insulated.
Use a body harness or restraining belt with a lanyard attached to the boom or basket to prevent worker(s) from being ejected or pulled from the basket.
Set the brakes, and use wheel chocks when on an incline.
Use outriggers, if provided.
Do not exceed the load limits of the equipment. Allow for the combined weight of the worker, tools, and materials.
Ensure workers who operate aerial lifts are properly trained in the safe use of the equipment.
Maintain and operate elevating work platforms in accordance with the manufacturer's instructions.
Never override hydraulic, mechanical or electrical safety devices.

Strategies For Safer Trenching

OSHA reports excavation fatality rates are 112 percent higher than general construction activities. Following some basic safety procedures can minimize the possibility of a trench accident, or reduce the amount of time and effort needed for a rescue if an accident occurs. Here are some key strategies for safer trenching:

1. Study Before Digging. An individual with specialized training in trenching safety should inspect the site carefully and address challenges associated with the soil that will be handled, utility lines or pipelines, underground storage tanks, nearby traffic and the possibility of water unexpectedly filling the trench.

2. Once Excavation Begins:

Keep heavy equipment away from trench edges.
Keep spoils/surcharge loads at least 2 feet (0.6 meters) from trench edges.
Know where underground utilities are located.
Test for low oxygen, hazardous fumes and toxic gases.
Inspect trenches at the start of each shift, and any time an action increases the hazard.
Inspect trenches following a rainstorm.
Do not work under raised loads.

3. Provide and Protect Access. If the trench is at least four feet deep, OSHA regulations call for proper egress within 25 feet of all workers. The egress must be designed by someone with the proper training, and integrity must be ensured so that components of the egress will not separate in the event of an incident.

4. Be Ready to Rescue. The safety plan should include a complete rescue plan that addresses how workers should respond in a variety of situations. The rescue plan should also address who will brief and coordinate with the fire department and other outside rescue personnel that respond to an incident.

AASE Calls for Action on Workplace Fatalities

In response to the just-released BLS workplace fatalities report, The American Society of Safety Engineers issued a statement that "... the fact that this nation's fatalities are not significantly decreasing should be a call for action, not complacency." ASSE urged "everyone concerned with worker safety not to accept as reasonable the preliminary results of this report that show little change in the number of workplace fatalities between 2009 and 2010."

"A statistical plateau of worker fatalities is not an achievement but evidence that this nation's effort to protect workers is stalled.These statistics call for nothing less than a new paradigm in the way this nation protects workers," said ASSE President Terrie Norris.

"Instead of a tug of war over compliance to prescriptive standards that cannot address each workplace, this nation's approach to workplace safety must encourage a specific dialogue about the most important risks in each workplace that engages employers, workers and OSHA in a cooperative effort to address those risks ...," he continued.

Staying Alert About Fatigue

Before you brush sleepy workers aside as a minor problem, consider that fatigue has been a contributing factor in nearly every headline-grabbing industrial accident from the Chernobyl nuclear plant to the Exxon Valdez oil spill. It's considered a major contributor to as many as two of every five commercial vehicle accidents. Fatigue has any number of causes (beyond not getting enough sleep), including many common factors in the workplace.

Employers need to take fatigue seriously, because it's an actual physical problem and not a lack of character or work ethic, and because it has a significant impact on worker safety and the bottom line. No Update Yet on GHS. OSHA announced plans to issue a final rule this month on implementing the Globally Harmonized System for Classification and labeling of Chemicals (GHS) into the Hazard Communication Standard. So far, nothing has been announced. Check the OSHA Hazard Communication page for details.

Reforms in Store at OSHA, EPA and Elsewhere.
In late August, the White House announced final regulatory reform plans for federal agencies and departments, including OSHA and EPA. They include "hundreds of initiatives that will reduce costs, simplify the system, and eliminate redundancy and inconsistency." The reforms cover 20+ agencies, including a Department of Health and Human Services proposal to remove unnecessary regulatory and reporting requirements for hospitals and other healthcare providers, and a Department of Labor rule to simplify and improve hazard warnings for workers. ASSE Updates Standard for Handling Explosives in Construction and Demolition. ASSE recently released a revised A10.7 standard for Construction and Demolition Operations, titled, Requirements for Transportation, Storage, Handling and Use of Commercial Explosives and Blasting Agents. The Safety A10.7 standard is applicable to the storage, handling and use of commercial explosives and blasting agents in the construction industry. The standard provides best practices for commercial explosive use and should be used to guide handling in construction and demolition environments. The standard should not, however, be applied to pyrotechnics, small-arms ammunition, or explosive power packs in the form of explosive-activated or explosive-charged construction devices such as explosive rivets, explosive bolts, charges for driving pins or studs, and cartridges for explosive-activated power tools. 4,547 Fatal Occupational Injuries Recorded in 2010

Preliminary numbers released by the Bureau of Labor Statistics (BLS) show 4,547 fatal work injuries recorded in the United States in 2010, about the same as the final count of 4,551 fatal work injuries in 2009.

U.S. workers suffered fatal work injuries at a rate of 3.5 per 100,000 full-time equivalent workers, the same as 2009. Twenty-seven states and the District of Columbia reported higher numbers of fatal work injuries in 2010 than in 2009, while 23 states reported lower numbers. Key preliminary findings of the 2010 Census of Fatal Occupational Injuries:

The number of fatal injuries among wage and salary workers increased by 2 percent
Work-related fatalities resulting from fires more than doubled from 53 in 2009 to 109 in 2010 - the highest count since 2003.

Fatality causes, ranked by event or exposure:

1. Transportation incidents: 1,766
      55% were highway accidents
2. Assaults and violent acts: 808
3. Contact with objects and equipment: 732
      55% struck by object or equipment
4. Falls: 635
      81% falls to lower level
5. Exposure to harmful substances of environments: 409
      40% contact with electric current
      34% exposure to caustic, noxious or allergenic substances
6. Fires and explosions: 187

Final 2010 fatality data will be released in spring 2012.

Are Manufacturers #2 on OSHA Target List?

A review of data from OSHA's Severe Violator Enforcement Program (SVEP) suggests that OSHA is targeting manufacturing operations. Nearly 20% of all companies placed in OSHA's SVEP are in the manufacturing industry, according to data released in July. That makes manufacturers the number two target behind construction firms.

SVEP focuses on companies that have experienced workplace fatalities and those that expose workers to severe occupational hazards or high priority hazards from OSHA's National Emphasis Programs. Hazards commonly found in manufacturing operations include amputations, combustible dust and crystalline silica exposure.

Employer Tool Kit Available for Drive Safely Work Week in October

Although OSHA's head promised new GHS labeling standards in August, the agency has now published a target date to align U.S. labeling of hazardous chemicals with international standards. According to it's semiannual agenda, OSHA plans to issue a final rule by September to implement the Globally Harmonized System for Classification and Labeling of Chemicals (GHS) into the agency's Hazard Communication Standard.

Proposed changes included in the new rule:

Renaming Material Safety Data Sheets (MSDSs) to Safety Data Sheets (SDSs)

Displaying pictograms and signal words on container labels

Introduction of new chemical classifications

Are You Meeting 2011 ADA Requirements for Accessible Parking Spaces?

New regulations for the Americans with Disabilities Act (ADA) became effective in March, including a requirement of one van-accessible parking space for every six standard handicapped accessible spaces (up from one per eight spaces under the previous law).

Signage instructions for accessible spaces are: "International symbol of accessibility placed in front of the parking space mounted at least five feet above the ground, measured to the top of the sign. Van-accessible spaces include the designation "van accessible."

The Department of Justice has developed a guide to explain requirements and help small businesses comply with the revised rules.

Online Help with OSHA Crane Rules

Federal OSHA law mandates that riggers and signalers working as part of a crane crew be currently certified through the National Commission for the Certification of Crane Operators (NCCCO). The NCCCO now has dedicated an area on its website to helping employers, operators, riggers, signalers and others from industry better understand the personnel qualification requirements under federal OSHA's new rules for cranes and derricks in construction.

Understanding the OSHA Rule and How It Affects You compiles resources from OSHA and NCCCO including full regulatory text, historical background and OSHA fact sheets explaining the qualification requirements for each job function. The page also includes links to analysis and relevant documents that can help employers and employees understand the rules and ensure compliance with the new personnel qualification requirements.

A guide details which cranes are covered by the rule and shows explanatory graphics including a flowchart for determining when a certified operator is required for articulating cranes and loaders. A memo and letter of interpretation from OSHA that clarify the difference between "construction" (which this rule applies to), and "maintenance" (which it doesn't), are also included.

Global Study Identifies Workplace Training Shortfalls

Results of a just-released global study provide some insights on workplace training that could help you improve safety training in your organization. More than 3,000 government and commercial training-related managers responded to the survey conducted by ESI International in March.

The study points out some striking contradictions between how effective organizations think their training programs are, and their ability to prove any actual on-the-job application of that training.

Sixty percent of those surveyed indicate that they do not have a systematic approach to prepare a trainee to apply learning on-the-job. Almost 60 percent of respondents use either informal / anecdotal feedback or "simply a guess" to determine if employees actually apply safety training while on the job.The top three strategies considered most important for effective training:

Ensuring trainees have the time, resources and responsibility to apply learning
Support of managers
An instructional approach that simulates the actual work environment

The "possibility of more responsibility" and an impact on HR / performance reviews were cited as the most important rewards for motivating trainees.
